I, the above signed, by virtue of my individual signature below, hereby release Snow Monkey Pty Ltd and its employees and agent from all liability howsoever arising and whether in respect of personal injury or death occurring in respect of me or any other person whosoever, or for damage to any property whatsoever resulting from the possession or use of any equipment as hired by you and inclusive of the equipment listed above. I have been made aware that the ski bindings on such equipment are of the release type designed to reduce,as far as possible, the risk or degree of injury or damage arising out falling or any form of accident, but that these bindings do not always release under all circumstances or may not be properly adjusted to release and that no warranty or representation is given or made by Snow Monkey, its employees or agents that such bindings or other equipment are such as to minimise any such injury or damage. Terms and Conditions Statement I acknowledge, by the signing of this form that the bindings were adjusted to the DIN setting based on the information listed above and that I have not misrepresented information concerning weight, height, age, and skier type to Snow Monkey or the shop. I confirm that I/we are using all equipment accepting full responsibility for any injury to me or any other person or any damage to any property and that I have read and understood the terms and conditions of the release and the equipment has only been made available to me on you receiving this conformation from me. I further agree to reimburse Snow Monkey for any loss, theft or any damage to any equipment as hired by me. I further agree that snowboard bindings are not a safety release binding, they are set as per my request and I accept possible injury or death.
